Companion Puppy Sales Agreement Contract and Bill of Sale

 

This agreement is entered into this (day) (month) (year) between (Seller's name) hereinafter referred to as "Seller" and (Buyer's name) hereinafter referred to as "Buyer".

Buyer agrees to pay Seller the purchase price of (purchase price) on (day) (month) (year) for one (1) Samoyed puppy hereinafter referrred to as "Samoyed" sold as a pet/companion with Limited Registration privileges with the American Kennel Club, Inc. hereinafter referred to as "AKC".

1)  Buyer agrees to pay all expenses for transportation and delivery of the Samoyed from the Seller’s kennel to a point designated by the Buyer via the fastest and safest route. Seller does not ship puppies via air; they must be picked up buy Buyer or licensed professional pet ground transportation service.

2)  Samoyed is guaranteed to be in good health and free from communicable disease at the time of sale. Buyer shall have the Samoyed examined by a licensed veterinarian within five (5) business days of receiving the Samoyed. Full refund of sale price will be given upon the return of Samoyed to the Seller within this period of time and receipt of a letter from a licensed veterinarian stating that the Samoyed is not in good health or free from communicable disease.

3)  Samoyed is NOT for resale or placement without the express written consent of the Seller. If, at any time, Buyer or Buyer’s Estate/Executor is either unwilling or unable to keep the Samoyed; or decides to sell or place Samoyed in another home, Seller will be notified and given first option to the Samoyed.

4)  The kennel name, Uakea, must precede the Samoyed’s registered name on the AKC certificate.

5)  Samoyed will be co-owned with Seller. Seller will, at no additional cost to the Buyer, register the Samoyed with Limited Registration privileges. The AKC will send the registration certificate directly to the Buyer.

6)  Obedience Class completion refund.

     a)  The obedience class must be completed within one (1) year of the purchase date of Samoyed.

     b)  A refund of $75.00 will be sent within thirty (30) days of receipt of a copy of the Certificate of Completion.

7)  Samoyed is guaranteed to be free from Congenital Hip Dysplasia under the following conditions:

     a)  Samoyed has not be kept on slick surfaces or on such surfaces where secure footing is difficult.

     b)  Samoyed is not injured in an accident, falls, blows, or suffers from excessive weight or poor diet in such a manner as to cause damage to the hips.

     c)  At the minimum age acceptable to the Orthopedic Foundation for Animals (hereinafter referred to as OFA) of twenty-four (24) months of age but not after the age of thirty-six (36) months, the Samoyed must have its hips x-rayed by a licensed veterinarian familiar with the proper positioning of the hips and the results submitted to the OFA for evaluation and grading. Buyer is responsible for payment of all costs incurred relevant to the x-rays and OFA fees. The OFA will make the final determination of hip dysplasia.

8)  In the event the Samoyed is found to be dysplastic by the OFA, proof of their determination, on their official letterhead, shall be given to the Seller. Buyer may then exercise one of the following options within sixty (60) days of receiving notification from the OFA:

     a)  Buyer may return the Samoyed to the Seller along with all ownership and signed AKC registration documents for a 50% refund of purchase price; or

     b)  Buyer may retain ownership of the Samoyed. By exercising this option the Buyer waives all right and title to further claims or options against the Seller; or

     c)  If Buyer chooses not to exercise one of the options above within the prescribed sixty (60) days of receiving notification from the OFA, the Buyer waives all right and title to further claims or options against the Seller.

     d)  All of the above Congenital Hip Dysplasia guarantees, as outlined in items #7 and #8, are void as follows:

          i)  If Samoyed is used for breeding;

          ii)  If Samoyed is diagnosed to be dysplastic by procedures other than x-ray submission to the OFA and their determination of hip dysplasia.

9)  Samoyed is guaranteed to be free from Progressive Retinal Atrophy (hereinafter referred to as PRA) under the same OFA provisions stated in #6. The OptiGen XL-PRA Test has identified both sire and dam of Samoyed to be "genetically clear," "noncarriers" or, more formally, "homozygous normals". If Samoyed is examined by a veterinary ophthalmologist that is a current member of the American College of Veterinary Ophthalmologists and diagnosed to have PRA, proof of their determination, on their official letterhead, shall be given to the Seller. Buyer may then exercise one of the following options within sixty (60) days of receiving diagnosis:

     a)  Buyer may return the Samoyed to the Seller along with all ownership and signed AKC registration documents for a 50% refund of purchase price; or

     b)  Buyer may retain ownership of the Samoyed. By exercising this option the Buyer waives all right and title to further claims or options against the Seller; or

     c)  If Buyer chooses not to exercise one of the options above within the prescribed sixty (60) days of receiving notification from the OFA, the Buyer waives all right and title to further claims or options against the Seller.

10) Buyer will not spay/neuter Samoyed until minimum of twenty-four (24) months of age.

11) Buyer agrees to provide a healthy, safe, protected and loving environment for the Samoyed.

     a)  Samoyed will be fed a diet that, along with routine exercise, will keep them at a healthy weight and maintain a sound body.

     b)  Buyer will provide adequate veterinary and medical care to keep the Samoyed free from internal and external parasites. In many regions of the United States, that includes flea and tick prevention and heartworm preventives nearly year round.

     c)  Buyer will keep the Samoyed in a healthy coat with routine combing, brushing, and bathing which will also prevent matting of the coat and assist in maintaining healthy skin beneath the coat.

     d)  Buyer agrees not to shave or cut Samoyed’s coat with the exception of medical procedures. (The Samoyed has a double coat which insulates and protects them from both cold and heat so its removal can result in frostbite or sunburn).

     e)  Buyer agrees that the Samoyed will not be kept outside or in a garage for excessive periods of time. If possible, the Samoyed will be securely fenced or on a leash when outdoors.

12) Buyer will notify Seller of any life-threatening diseases or conditions that lessen quality of life so Seller may offer assistance in seeking information, qualified health care provider or simply a shoulder to lean on.

13) Buyer will keep Seller informed of any change of name, address, email address or phone number.

14) Buyer will have a fourteen (14) day trial period during which the Samoyed may be returned to the Seller for a full refund of purchase price. Buyer is responsible for all transportation and delivery expenses.

15) Buyer agrees that failure to comply and fulfill all aspects of the terms and conditions contained in this agreement constitutes just cause and thereby the Seller has all rights to repossess the Samoyed from the Buyer together with documents necessary for the transfer of ownership to the Seller, at no cost to the Seller.

16) Buyer agrees that if the Samoyed is ever found to be abused, neglected, malnourished, primarily living outdoors, in serious danger or in a life-threatening situation that the Buyer either cannot or refuses to correct immediately, for whatever reason, the Seller has the right to repossess the Samoyed. It will be at the sole discretion of the Seller whether Buyer regains ownership of the Samoyed in the event conditions are corrected.

17) If Seller has to take legal action to enforce this contract, it will be handled in the court system of Seller’s residence and the Buyer will pay all attorney fees.

This Sales Agreement Contract and Bill of Sale is entered into between Buyer and Seller and is non-transferable without the express written approval of the Seller.
